These Terms & Conditions ("Terms") govern your use of the Systems Watchdog platform, including the website at systemswatchdog.com and the associated desktop applications (PC Kiosk and Systems Watchdog), operated by Systems Watchdog ("we," "us," or "our"). By using our platform, you agree to these Terms.

1. Service Description

Systems Watchdog is a device monitoring and management platform that provides:

• Real-time monitoring of computer systems (CPU, memory, disk, temperature, network health)
• Alert notifications via email, SMS, Slack, webhooks, and browser push
• Remote device management and diagnostics
• Kiosk mode for locked-down public-facing displays

2. Account Registration

To use Systems Watchdog, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

3. Acceptable Use

You agree to use Systems Watchdog only for lawful purposes. You may not:

• Use the platform to monitor devices you do not own or have authorization to manage
• Attempt to gain unauthorized access to the platform, other accounts, or connected systems
• Use the alert system to send unsolicited messages or spam
• Reverse engineer, decompile, or disassemble the software
• Use the platform in any way that could damage, disable, or impair the service

4. SMS Alert Terms

• Opt-in: SMS alerts are only sent when you explicitly configure a phone number as an alert destination and enable specific alert types
• Message Frequency: Varies based on your alert configuration and system events. Alerts are subject to configurable cooldown periods to prevent excessive messaging
• Message and Data Rates: Standard message and data rates from your mobile carrier may apply
• Opt-out: You may stop SMS alerts at any time by replying STOP to any message, removing the SMS alert channel from your dashboard, or disabling specific alert types
• Help: Reply HELP to any message for assistance, or contact us at support@systemswatchdog.com
• Supported Carriers: SMS alerts are delivered via Twilio and support all major US and Canadian carriers

5. Data Collection and Privacy

Your use of Systems Watchdog is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the platform, you consent to the data practices described in the Privacy Policy.

6. Device Monitoring

By installing and running the Systems Watchdog or PC Kiosk application on a device:

• You authorize the application to collect system metrics (CPU, memory, disk, temperature, network status, battery, installed hardware) and transmit them to the Systems Watchdog server
• You confirm you have the authority to install monitoring software on the device
• You acknowledge that the application may modify system settings when kiosk hardening features are enabled

7. Service Availability

We strive to maintain high availability of the Systems Watchdog platform but do not guarantee uninterrupted service. We are not liable for:

• Temporary service outages due to maintenance, updates, or technical issues
• Delays or failures in alert delivery caused by third-party services (email providers, Twilio, Slack)
• Data loss resulting from device malfunction, network issues, or circumstances beyond our control

8. Intellectual Property

The Systems Watchdog platform, including all software, designs, logos, and documentation, is the intellectual property of Systems Watchdog. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Systems Watchdog shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you for the service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Systems Watchdog from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account by contacting us. Upon termination, your right to use the platform ceases immediately, and we may delete your account data.

12. Changes to Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the platform after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
